Service Agreement for Scheduled Message Delivery to Designated Recipients

This Service Agreement (“Agreement”) is entered into between WithLove.Family, headquartered in Italy (“Provider”), and the user of the Service (“User”).

By completing the registration process, the User fully and unconditionally accepts this Agreement.

1. Purpose of the Service

   The Service allows the User to create and schedule messages (email, video, audio or printed communications) to be delivered to designated recipients (“Recipients”) if the User fails to respond to periodic verification messages for a continuous period set within the application (“Scheduled Messages”).

   The Service relies solely on lack of response and does not confirm or certify any personal event.

2. Verification Procedure

   The system sends verification messages at intervals defined in the app. If the User does not respond within the configured time frame, Scheduled Messages are automatically released.

   Delays, delivery failures or technical issues may occur due to third-party providers, incorrect email addresses, filters, network problems or other factors outside the Provider’s control.

3. Service Plans and Fees

   • Basic Plan: free of charge
   • Premium Plan:
     • Annual Subscription: USD 5/year
     • Lifetime Access (one-time payment): USD 30

   Any taxes, conversion fees or banking charges are the responsibility of the User.

4. User Responsibilities

   The User is solely responsible for the content of the messages and their compliance with applicable law.

   • providing accurate and up-to-date contact information;
   • ensuring recipients’ addresses are valid and reachable;
   • configuring verification intervals correctly;
   • protecting login credentials.

5. Advanced Limitation of Liability

   The Service is provided “as is” and without guarantees of uptime, continuity or error-free operation.

   The Provider shall not be liable, under any circumstances and for any reason, for failure to deliver or failure to receive Scheduled Messages, regardless of cause.

   Examples include failures caused by:

   • incorrect, inactive or unreachable email addresses;
   • spam filters, provider blocks or firewalls;
   • postal service issues, email provider outages, cloud failures;
   • technical errors, misconfigurations, missed responses by the User;
   • network saturation, cyberattacks or unpredictable events.

   By registering, the User irrevocably waives any right to claim damages, compensation or reimbursement from the Provider, even in cases of complete failure to deliver Scheduled Messages.

6. Privacy and Cookie Policy

   Processing of personal data is carried out according to applicable laws. Full information is available at:

   Use of the Service constitutes acceptance of these policies.

7. Term, Termination and Suspension

   The Agreement has an indefinite duration. The User may delete their account at any time through the application.

   The Provider may suspend or terminate the Service in case of misuse or violation of this Agreement.

8. Governing Law and Jurisdiction

   For U.S. and non-EU Users, this Agreement is governed by the laws of the State of [STATE, es. Delaware]. Any dispute shall be submitted to the courts of that State.
